Just after being sworn in as the 46th American president on Wednesday, Biden directed Congress to pass a sweeping new bill to overhaul the U.S. immigration system. The U.S. Citizenship Act of 2021 includes a pathway to citizenship for 11 million undocumented immigrants, clears employment-based visa backlogs, and claims to make it easier for STEM graduates to stay in the country. The call to action was part of a Day 1 Presidential Memorandum, ordering the Secretary of Homeland Security, in concert with the Attorney General, to codify protections for young people who arrived here as children, so-called Dreamers and Deferred Action for Childhood Arrivals (DACA) recipients. DACA refers to a designation, first offered in 2012 under President Barack Obama, that allows a small population of undocumented people to legally work for American companies. The centerpiece of the Biden proposal is to give 11 million undocumented immigrants a path to citizenship. It also includes modest provisions for reforming the H-1B visa program for highly-skilled foreign workers, including work authorizations for dependents of H-1B visa holders. If passed, the measure would mark the country’s first substantial immigration reform since 1986.
